Mac and PC Consulting Pty Ltd t/as Mac and PC Computer Repairs
1. Definitions and Scope
1.1 Definitions
In these Terms and Conditions:

Supplier, we, us, our means Mac and PC Consulting Pty Ltd (ABN 62 145 095 781) trading as Mac and PC Computer Repairs.

Customer, you, your means the person or entity requesting Goods or Services from the Supplier.

Services means computer repair, diagnostics, technical support, and data-related services (where requested).

Goods means any hardware, parts, accessories, or other goods supplied by the Supplier.

Quote means a written estimate provided by the Supplier.

Device means any computer, phone, tablet, storage device, or related equipment provided for servicing.

1.2 Scope
These Terms apply to all Goods and Services supplied by the Supplier and all Devices left in the Supplier’s care, unless otherwise agreed in writing.
These Terms apply to retail and business customers. Any discretionary payment arrangements for business customers are informal and do not constitute a credit facility.
2. Acceptance of Terms and Authorisation to Proceed
2.1 Acceptance
These Terms are accepted when the Customer:

drops off or delivers a Device for diagnosis or repair;

requests Services verbally, by email, or via the Website;
-
approves a Quote verbally or electronically; or
-
instructs the Supplier to commence Services.
2.2 Authority
By providing a Device, the Customer authorises the Supplier to perform diagnostics, testing, and agreed repairs, including installing, removing, or replacing components as reasonably required.
2.3 Quotes and Estimates
Unless stated otherwise in writing, all Quotes are estimates only.
The Customer acknowledges that faults may be hidden or multiple issues may exist. Where additional work materially affects cost or scope, reasonable efforts will be made to obtain approval before proceeding.
2.4 Verbal and Electronic Approvals
Verbal approvals (including by phone) and approvals given by email or electronic communication constitute valid authorisation to proceed and incur associated costs.
3. Quotes, Pricing and Variations
3.1 Diagnostic Fees
The Supplier may charge a diagnostic or assessment fee for fault-finding.
Diagnostic fees vary depending on the Device and complexity (for example, desktops or iMacs may differ from laptops or portable devices).
Diagnostic fees are payable whether or not the Customer proceeds with repairs, unless otherwise agreed.
3.2 Pricing
Pricing is based on:
-
an agreed Quote;
-
an agreed price; or
-
where no Quote is provided, time, materials, and Services performed.
Prices are current at the time provided and may change without notice.
3.3 Variations
Additional work, parts, or Services not included in the original Quote constitute a variation and may incur additional charges.
3.4 Parts and Special Orders
Parts costs are additional to labour unless stated otherwise.
Special-order or non-stock parts may require payment in advance.
4. Repair Notice, Data and Backups
4.1 Devices May Contain Data
Devices may contain personal information, software, and configuration settings.
4.2 Repair Notice
Before repairing products capable of storing user data, notice is given that repair activities may affect or result in data loss.
4.3 Customer Responsibility for Backups
Unless a backup, data transfer, or data recovery service is purchased, the Customer is solely responsible for backing up data prior to Services.
The Supplier does not guarantee data preservation.
4.4 Access and Security
Where login access is required, credentials may be provided at the Customer’s discretion. Reasonable steps are taken to limit access to what is necessary.
Customers should log out of sensitive services unless required for the agreed work.
4.5 Data Recovery
Data recovery services are provided on a best-effort basis only, with no guarantee of recovery.
4.6 Remote Support
Where remote support is used, the Customer authorises access for the duration of the session only, using session-based or one-time access methods.
5. Services, Parts and Third-Party Repairs
5.1 Parts Used
The Supplier aims to use OEM parts where available. Where not available or appropriate, compatible or equivalent quality parts may be used.
5.2 Parts Warranty
Any warranty on parts is limited to the warranty provided by the manufacturer or supplier.
Warranty claims may require parts or Devices to be returned for assessment. Acceptance and timeframes are determined by the supplier, not the Supplier.
5.3 Labour and Services
Services are provided with due care and skill as required by the Australian Consumer Law. No additional labour warranty is provided beyond statutory guarantees.
5.4 Third-Party Repairs
Devices may be referred to third-party or specialist repairers. Repairs and warranties in those cases are provided by the third party, and timeframes and outcomes are subject to their processes.
5.5 Delays
The Supplier is not liable for delays caused by factors outside its control, including parts availability, shipping delays, or third-party processes.
6. Uncollected Goods, Storage and Disposal
6.1 Collection
Once notified that a Device is ready for collection, the Customer must collect it within a reasonable time.
6.2 Contact Attempts
If a Device remains uncollected, the Supplier will generally attempt to contact the Customer two (2) or more times. Customers must keep contact details current.
6.3 Storage Period
Uncollected Devices may be stored for up to six (6) months from the date they were ready for collection.
6.4 Data Protection and Disposal
After six (6) months, the Supplier may:

securely erase or destroy data; and
-
dispose of, recycle, or otherwise deal with the Device
as a single process. Data recovery will not be possible after this point.
6.5 Queensland Law
Disposal or sale of uncollected Devices will be handled in accordance with the Disposal of Uncollected Goods Act 1967 (Qld).
6.6 No Liability After Disposal
To the extent permitted by law, the Supplier is not responsible for data or content left on Devices not collected within this timeframe.
7. Payment and Non-Payment
7.1 Payment Terms
Payment is due upon completion of Services or supply of Goods, unless otherwise agreed in writing.
7.2 Payment Before Release
The Supplier may withhold release of Devices or Goods until payment is received in full.
7.3 Discretionary Payment Arrangements
Short-term payment arrangements may be allowed at the Supplier’s discretion but do not create a credit facility.
7.4 Non-Payment
The Supplier may suspend Services or retain Devices until payment is received. Section 6 continues to apply.
8. Warranties and Consumer Guarantees
8.1 Australian Consumer Law
Goods and Services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).
8.2 Goods
For major failures, Customers are entitled to a replacement or refund. For non-major failures, repair or replacement within a reasonable time applies.
8.3 Services
Services are provided with due care and skill. Remedies apply in accordance with the ACL.
8.4 No Extended Warranty
No extended or independent warranties are provided beyond those required by law or offered by suppliers.
9. Limitation of Liability
9.1 ACL Rights Preserved
Nothing in these Terms excludes rights under the ACL.
9.2 Limitation
To the extent permitted by law, liability is limited to re-supplying the Goods or Services, or paying the cost of having them supplied again.
9.3 Data and Software
The Supplier is not liable for data loss, software issues, or configuration changes except where required by law.
9.4 Pre-Existing Faults
The Supplier is not responsible for pre-existing or latent faults unrelated to the Services provided.
9.5 Third-Party Services
No liability is accepted for failures or incidents involving third-party software, services, or vendors.
9.6 Consequential Loss
To the extent permitted by law, the Supplier is not liable for indirect or consequential loss.
9.7 Storage and Handling
Liability for stored Devices is limited to repair or replacement of the Device itself and excludes data.
10. Termination and Cancellation
10.1 Cancellation Before Work
Cancellations before work starts should be made as soon as possible. Costs already incurred may be payable.
10.2 Cancellation After Work Starts
If cancelled after work has commenced, the Customer must pay for work performed, diagnostics, and parts ordered.
10.3 Inactive Jobs
Jobs with no response may be treated as inactive and are subject to Section 6.
10.4 Supplier Termination
The Supplier may suspend or terminate Services for non-payment, unsafe requests, or breach of these Terms.
11. Privacy
Personal information is handled in accordance with the Supplier’s Privacy Policy, available on the Website.
If there is any inconsistency, the Privacy Policy prevails in relation to personal information handling.
12. General
12.1 Governing Law
These Terms are governed by the laws of Queensland, Australia.
12.2 Variation
The Supplier may update these Terms from time to time. The version on the Website applies at the time Services are requested.
12.3 Severability
Invalid provisions are severed without affecting the remainder.
12.4 Entire Agreement
These Terms, together with any accepted Quote and the Privacy Policy, form the entire agreement.
